Hi, I am a US Citizen and own a small medical clinic. My brother is staying here illegally with his family and kids. He came here with a different name and now staying illegally. He has a Bachelor and a Master degree from India. If I file a labor cert. for him, will Immigration ask for his entry documents? OR what else can I do for him to make him legal here?

Yes, he will definitely get busted if you file for labor. Instead, wait and see what happens with the H-5 bill that is debated in Congress. If it becomes law, which it looks like it's ging to happen, your brother's problem is solved, since this bill provides a direct path for illegals to become permanent residents through a temporary working visa program called H-5.
