My US Citizen brother petitioned for me 13 years ago. I just received DS 3032 in india. He has just received the approval of my petition which he is supposed to sign and send back. Unfortunately he is not in a position to sign it right now. How long can he hold off to signing the approved petition before it becomes invalid?

Please let me know soon.

reason?

Can you provide some more details on "Unfortunately he is not in a position to sign it right now". Are you referring to his eligibility to meet affidavit of support conditions or something else?

REASON.

the reason is a personal family reason. affidavit of support is not a problem at all. how much longer is it OK before the documents (approved petition) he received become invalid?

Should be good for at least a year.

1 year

leroythelion is right in saying that you can continue with your consular processing within 1 year. It would be a good idea to write to the consulate and get their consent to make sure.

If it was an affidavit problem, anyone can give that on behalf of your brother.

Thanks, can you provide me with the source.

Leroy, MLPBob...thanks for your response; could you please provide me with your source of the one year validity of the approved petition.

Appreciate your response.

1 year

The letter from NVC as well as the consulate mention the 1 year time period to pursue the approved immigration petition. I don't have the link to the FAM. But go to the department of state website and look it up. It will certainly have the most detailed and up to date information.

The application for an immigrant visa should be good for at least one year. My own was 8 months old when I finally sent my Packet III to the NVC (employment-based immigration). I remember reading on Ron Gotcher's site before it was updated something like, "there is no problem applying within one year, there may be a problem if you apply after more than a year (sic)". The point is that you are supposed to apply when you are ready to immigrate.
