hi guy! I have filled out my I-130 and I-485. They cashed my checks on Thursday,08/14/2008, last week. Yesterday, I found out that my I-130's check fee was showing return on my bank statement. So I want to know if the INS will resubmit the check again or they will send me my application back?

Ask you bank/ look at the scanned image.

Why not call up your bank if find out what they seeing. Its rather odd to see USCIS refunding fees. They generally don't refund fees.

Also, look at the scanned image of the check. If you look at the reverse, you might be able to decipher a receipt number sometimes. Try to add three letter prefix to that like MSC*_ _ _ _ ..... If you are able to then you can login to USCIS onlince accout and see what happens. In worst case, call the national customer service to check.

Hope this helps.

Do you have a lawyer. Because I had a similar situation recently. My lawyer submitted renewal EAD (x3) + 1 renewal AP, which where 3*$340 + 1*$305.
Then they returned the paperwork as a rejection notice complete with the $1325 check. Then the message read that we need to resummit with the appropriate fees. Which we had in the first place. Somebody is really screwing up there. So my attorney talked to several people at USCIS and he then wrote a letter explaining the nature of the problem and gave them two options:
They either (1) accept the applications with the $1325 check or (2)
accept just the applications and process them and send him back his $1325.
That was the first week of August. Yesterday he received the receipt notices in the mail for all 4 applications and they kept the check.
In the first attempt they received the applications on July 24, but because somebody had no idea what they where doing, my receipt date now is August 8 (so I lost about 2 weeks). Hopefully I will get the renewal before the card expires on October 23 or I will be really pissed.

I have also read of people having their applications returned because USCIS hired contractors that don't really know what they're doing..
I guess the only thing to do is re-submit everything explaining the correct amounts to them, although they should know better..

My checks were not refunded, but I filed 485, 130 + all the bells and whistles (other forms). My 130 check was cashed, I received noa and all went silent for the rest of my forms. 3 looong wks went by, then I received the rest of the other forms telling me to file concurrently with 130 or evidence that 130 was filed. Ouch! that hurt me. I simply resent my docs with a cover letter explaining the above + copy of 130 noa. Finally this wk i receive noa for the rest.

Before all this I sent 102. Not familiar? Initial issuance of 1-94 for my daughter who came as an unaccompanied minor and was never issued one. Never noticed when I picked her up, was too excited till I got home. Ok, I sent with all evidence in July, now I have an RFE for it. Ouch!-again. I just saw that online on Aug4. Haven't recieved the hardcopy. Wonder how long it takes to get here.

As far as I know they try 2 times to withdraw. So one bounce
shoudn't be a problem. I read it a couple times but I couldn't
find it right now.

hey guys! I called uscis yesterday. They told me to contact the financial department. I contacted them today and they told me they haven't received my returned check yet. They will send me an invoices and I have 14 days to pay. I can do it over the phone with my credit card, send them a check or money order. My option is going to be over the phone with my credit card.
