my 485 approval is being late

hello friends,
My I-485 is pending for a long time. Since, many members can guess more or less approval dates here, can you please give me a clue about my approximate date. My information as follows;

RD 10/28/02
ND 11/15/02
First EAC 11/22/02
Second EAC 11/22/03
Third EAC 10/30/04 I went to INS for third FP appointment
First FP 01/16/03, second FP 08/24/04
EAC-03-035-XXXXX
AD?????? :confused:

On Sep1st, I changed location inside the city, on Sep2nd, I Fedex AR-11, on Nov8, I refedex AR-11. My friends are telling me not to call their 800 number too much, cause every phone call is changing my online status. Please share your thoughs your opinions with me.

Eddie. My ND & RD are at early September, 2002.

In that sense, I am even more screwed that you are.

For some reason, USCIS folks have decided that these 2002 filers can
go to hell. Its almost as if we don't even exist.

1) Lawyer says...WAIT; can't do anything more.

2) USCIS now doesn't allow any enquiry over the 1-800-#

3) Congressman will show they are trying something and won't help you or
can't help you in any way.

4) And you can't have any out of the way handling like bribery or anything
of that nature.

5) Expedite request to USCIS will probably be outrightly rejected ( come on,
how can you request for expedited processing w/o having waited for
at least 5 years ? )

In other words, BIG TIME SCREWWWWWWWWWWWWWD

P.S Moral of the story : nobody helps those who don't help themselves

I perfectly understand your frustration. Was in a similar situation few days ago. It is hard to see all the fellow colleagues get the approvasls, and even worse when folks who filed a year or year and a half later get through while you are waiting!. But keep heart things will work out for you. They cannot specifically target anybody.

No point calling for congressional help, because I don't believe they can do things in a more timely manner to help anybody. Keep pestering the customer servise folks and try to see if you can speak to one of the approval managers. That's the only thing that helps even if they act reluctant to talk or give any details. If yours is a straight forward case there is no way they will not get to you shortly. Good Luck.

I feel like laughing my butt off..........:)

Now they have disabled Case Status Enquiry altogether. The phone system
leads you into a blind alley, making sure that what you see online is
all you can get.

In addition for my case, its even better. The message says, upon entering
my EAC # that due to "TEMPORARY TECHNICAL PROBLEMS" ( :) )
they can't access my records. In other words, SORRY DUDE...your case
was old, we had kept in a dingy room and there was this bad snow..you know
.. its Vermont...and your records got wiped away....dampness..cockroaches
and what not!!!

TOO BAD...sorry.

---Seriously, I was talking about USCIS. I believe they have changed some of their phone systems in the past few days and I did not bother calling them after approval, otherwise i was calling them on a weekly basis!!

---Anyway, if you get to talk to some of them please do not show this attitude!!
I had send you the post hoping that it may give you some assurance and hope, not to rile you up more, but since that is precisely what happended, I believe it was a mistake that I send you a reply!!

I agree with waiting Sumanta,
You sound like "throwing a towel" to this whole thing. I am still optimistic, because USCIS just ran out of their datelines they posted on their webside.
Also, I suggest you should keep calling that 800 number, just don't over do it!! I think we should call them in every 30 days till, we get their answer.
I also don't agree they throw our cases to same back room. If so, I wouldn't get updates on my "case online" page.
Anyway, I am as frustrated as you are but I have no way out but to have positive attitute about this matter. :(
 
it has been 26 month passed from my RD, no sings is I485. what should I do????

800 phone number is not giving any hope. any advice?

4th EAD being applied

I am applying for my 4th EAD. Did FP twice..look forward to a 3rd one
and then a 4th.
 
Here's where i am

1) I have e-mailed FBI at the Name Check e-mail address on Oct 19, 2004.
No replies yet.

2) I have sent FOIP fax to FBI. Haven't received any mail from FBI.

3) Congressman's office learnt on Dec 9, 2004 that my Case File was
placed with an adjudicator on Dec 1, 2004. What this means really,
I have no idea. Is the USCIS Congress Liaison bluffing and dodging
Congressman with some vague answer ? Have no idea.

4) Asked Congressman if they can take up matter with FBI about Name Check
from USCIS. Congressman's rep tells me that if it was really delayed for
FBI name Check, they should have jheard accordingly from USCIS
Congress Liaison. Is that right ? I have no idea.

5) Congressman to check again with USCIS after 60 days ( Feb 1 2005
timeframe ). Is that sounding hopeful ? Have no idea.

6) Case Status Enquiry said "Case pending Service Consideration. Allow 60-
-90 days". When does 90 days end ? Feb 1, 2005. Will it get done
by then ? Have no idea.

In summary. Have no idea. What can I do ? Have no idea.
Can I try Expedite Request ? Maybe. Around Feb time frame. Will that
help ? Have no idea.

What next ? Another Expedite Request. When ? Maybe March, April, May,
June, July, then 2006, 2007, 2008.....2040. By then I will be gone, I
presume.
 
Dont worry dude Sumanta, you will get case approval one fine day, out of the blue, within the next few months. Do not become too pessimistic, CIS does actually clear cases, they just take time to do so.

I agree with you. To many people ( in the USCIS ), few may equal 300, 400..

Do you know how much is 40 years ? 480 months...just a few months
delay here and there :)

Thanks for the inside info. Should I contact with my congressman too? If so, how do you contact them? what to tell them? since my RD is 28OCT, 2002 should I wait till 1FEB too.

we are in same boat, so I can definetly feel your frustiration. hopefully it's going to have happy ending.

Well, where do you stand ?

You can sure contact him. My qn is ...
have you contacted him before or is this the first time ?
Have you had status enquiries with USCIS ? If so , what's been the response
exactly ?
Each case is unique and diff....that's why there is no one best answer to
your qn.

My suggestion is ..FIRE ON ALL FRONTS ....

1) Do Status Enquiry with USCIS
2) e-Mail FBI for Name Check status.
3) Send FOIA Request to FBI
4) Contact Congressman and ask them for help

And do the above in parallel. i.e each of the above are independent threads
and don't try to tell one about another.
 
I never contacted my CM before

I first called USCIS on 22OCT. They notice my address was not correct, even though I FeDex AR-11 on 1SEP, I re-FeDex AR-11 on 22OCT. My LUD changed to "we have responded your inquery on 22OCT...."

On 8NOV I called them again to make sure address change was in place. After that my LUD was changed to "on 8NOV we have responded to your request..." I called them again on 9DEC. They took my info again and call on 9JAN. My LUD is not changing since then. Now I can not even reach live operator to ask "what's going on?" on the phone!!!!

same boat. Contemplating contacting CM for help

I contacted USCIS about my case status during Nov 1st week. Received standard response (not enough people to process in timely manner) on Nov 8th. Tried again last week, lets see what response they are going to send. These days I am getting that "TEMPORARY TECHNICAL PROBLEMS" message when I call 800 number. Atleast I can reach an operator.

Seriously thinking about contacting CM
