one of my friend works in NEW YORK, his consultancy company applied his LABOR from NEBRASKA under EB-3, it was almost 1 and half year, no status...

Recently he got another project with Consultancy company , if he switched the company what they promissioning, they will apply for GC, which they have preapproved Labor under EB-2


1. How come they can apply with preapproved labor, as INS is not accepting Pre approved Labor.

2. Oct 1 onwards the Dates went to Retre.., how they can apply 140 or 485

3. Does it ok for him to switch the company.

USCIS is thinking about stopping labor substitution, nothing concrete yet.

Depends on the PD of the pre approved labor. If the orginal labor filing was before 1999, the PD is current, otherwise he can apply I-140 only.

Even if he doesn't, are there any guarantees if that company will exsist few years from now when the PD becomes current?
Ask him to take up the best paying job available, GC will be approved eventually someday.
