Can a company file Multiple labor Certifications for the same employee from 2 different SWAs in the same state? what are the issues surrounding? If one gets certified what will happen to another? Should that be withdrawn? cld somebody please shed light on this ?
Thanks

I had two. One is done, the other still waiting in queue. I hope it won't get processed until after I got my GC :D

The lawyer said it can be used for substitue later. If anyone know there're problems with this, please post an response.

It is completely legal to file more than one labor cert
so long as the employer has an intent to fill up each.
I checked with several lawyers on this topic.

I've done it. The only real restriction is that you cannot have 2 LCs pending for the same person in the same position with the same SESA at the same time.

That was the case for me. Do I have to worry about the past now that one of them is alreay approved? Thanks

Last time that I had this type of situation the officer called me and asked which one we wanted to withdraw.

Jim,

So, would it be legal to have 2 LC-s pending for the same person, same position but in two different states? (My company HQ is in CO, but actual work site - in IL)?

Thanks,

regards

Jim,
Can an applicant apply for Mutliple positions(position grades are different) for the same company in different locations under same SESA

Hexamon

It's near to impossible for DOL to track applications pending at two different DOL office.

Also one can have multiple application pending at the same DOL ( or different DOL offices) as long as the offered position (i.e. job) by employer is different.

NY regular labor is more than 4 years behind, guess nobody bother checking for duplicates. Just saw they finally pass my Nov.98 filing date, haven't heard anything yet.

Remember, the only true crime is being caught ;)
