If anyone has a few minutes to help me out with my questions, I would appreciate it so much! I am a little confused...
I'm from Korea, and have 3 labor certificate applications applied and one approved (EB3) 2 days ago...
I have a BS from U of Chicago and have worked with a neurologist for 6 years now (4 years during college and 2 years after college). But the problem is that i was never under payroll, since I was not under H1 visa, but covered under 245i. The University of Chicago petitioned for my green card right when I graduated in 2004, but the department lost some of the grant and couldn't continue the process for me. So a different hospital filed for my PERM/EB3 and they just got it approved (in 1 week!). My question is... the requirement for my position stated BS+2 yrs of experience. But I have been working as a voluteer at the UofChicago hospital (who is NOT my current petitioner) for 6 years now. I have enough doctors to prove that I am knowledgeable and have been working here for 6 years and also have multiple publications to prove that I am eligible.
But 1. Does the experience have to be a 'paid' position? Or does any experience regardless of payroll count as experience. I could have NOT gotten paid because I don't have any sort of work authorization. Also, it is very common that certain medical research teams do not have enough money to hire people anyway so a lot of students do end up voluteering for the mere experience and publications...
2. Does the experience while going to school not count? If it does count as experience, my current petitioner could potentially file for I140 under EB2, using my 6 year experience at the hospital but I'm not sure that my volunteer experience counts. My attorney never bothered to explain the difference between EB2 and EB3 and I just heard that EB3 can take up to 2 years longer than the EB2 category...
Also, if my current petitioner switches from EB3 to EB2, (and we have LC approved) do we have to start the whole PERM process again? i.e from advertising and recruiting...?
I could potentially get a different firm to file for PERM/EB2 if I can't have the first petitioner switch from EB3 to EB2...
Please let me know if you have any insight on this... I'm trying to go to medical school, so I've taken the MCAT and am ready to go, but just don't have the green card for me to go...
