I had my 1st labor cleared with a priority date of sep-01 which was in EB2 Category. My I140 got rejected twice for the same because of 3 yrs degree. Meanwhile my company have processed another labor in perm to process my I140 under EB3 category.I am under 7th year of H1 extension.I was thinking to pursue the new labor under premium processing but in which case I will loose my priority date.Meanwhile my lawyer has come up with an option to get my education evaluation done which is for 3 yrs equivalent to 4 years US degree on the basis of 120 points scored and reapply I140 for the 1st labor.
Can my company apply I140 for both the labors ?
