multiple I-485 filing asylum/refugee

American?

Hi all, I do have a question about political asylum in usa, my friend filed i-485 as a result of asylum status in 2000 and still pending, he went out of the US briefly and on his return, he was admitted as a refugee per her I-94 more than 3 years ago. my qn is can she submit another i-485 based on refugee status while the asylum one is pending? Has anyone experinced this?? will this have any consequencies about her 1st filing? Thanx alot

I'm afraid this was an error of the Immigration Officer who issued the I-94 when your friend came back from the trip.

Asylee & Refugee statuses are essentially the same. The only difference is that one was predetermined and granted the status of refugee while they were overseas by the US Government - and the an asylee is someone who was given refuge after they have come into the USA.

So - to answer your question... Your friend cannot file an I-485 application as a Refugee because they don't have refugee status. I suggest they try to get a new I-94 issued to them - since the one they were given was probably valid for one year. They should wait for their Asylum-based I-485 application.

Hope this makes sense.
