My company is going to file a petition for Labor Certificate (RIR) on my behalf soon. Since green card through this path normally takes several years, I plan to file a self-petition for green card in the category of Extraordinary Ability at the same time. My questions are:
(1) Can I file two petitions at the same time? Is there any law stating that this is legal or illegal? Somehow the HR people of my company have the impression that this is illegal, which I am not sure is true. It would be great that I can prove them incorrect based on some official documents.
(2) Will one petition impact another in my situation? Suppose the company files the Labor Certificate (not sure if this can be called a first step of immigration petition) before I submit my EA petition, should I indicate on my I-140 of the EA petition that I have another pending petition?
