I am working as asst. prof in a university. my LC for EB-2 category was approved under PERM in Dec 2005 and am planning to submit I-140 soon. Due to significant retrogression delay in EB2 I want to file another application under EB-1. Is it possible to file I-140/485 for EB-1 without affecting the I-140 process under EB-2? Do I need to withdraw it before I can submit my application under EB-1?

Thanks for your time and help.

Since EB1 and EB2 both are retrogressed so you can file only I-140 and not I-485.
I do not think there should be any problem filing two I-140 but for that I suggest you to consul a reputed lawyer.

I am in similar situation. I heard from our university immigration personnel that it is possible to go apply (for I 140) both under EB2 and EB1.

One clarification I need is if we have two priority dates (one for PERM (EB2) and the other for I485 (EB1)). Does the earlier of the two count towards I 485 application.

Thanks in advance.
