Hi Fellow GC seekers,
I have a typical situation and need advice.
I have my own I 140 approved under the VSC ...yet to file 485
My Wifes I 140 is also approved for NSC ...yet to file 485

Now is the time to decide which one to persue or to persue both as different 485\'s with different principal benificiary\'s as they will be filed at different centers NSC/VSC.

Background:
the company i work is a very small company ( 7 employees)and mine will be the first 485 ,the company has a few 140 approved in the past but have not yet filed a 485.
My wife\'s company is large (15000 employees) but job security is questionable, since they are already paying for reduced hrs per week but are continuing the GC process.

Any Suggestions?
What is the best solution in this situation.

You can\'t have two I-485\'s

Irrespective of whether you are primary beneficiary or derivative beneficaiary you can\'t file two applications for adjustment of status. Only one application will be considered at a time.

Best is to decide which one you want to file and continue on H1 status without using EAD or AP. Later if by chance you have problem with this I-485, you can file the second application as long as that primary applicant is still on H1. Your approved I-140 is valid as long as you are in the same job.

Good luck!
