MTR or Appeal

Lawyer says that there is low chance of success if filing for MTR yet he wants to do MTR. I hear that there is a way to do MTR and Appeal in the same document, so that if MTR is denied then the decision will go to AAO. Can anybody give me some advice on what to do?

There is NO way to do MTR and Appeal in the same document.

The notice of appeal must be filed on Form I-290B - Notice of Appeal or Motion. With this form, you can do "Appeal" or "Motion". Not both at the same time.

You file this form to notify USCIS that you are appealing an adverse decision regarding your case. The appeal must be filed with the USCIS Service Center that made the original decision. An explanation may be filed in support of your appeal. The fee must be included, and the successful appeal rate is small.

You can also file this form to notify USCIS that you are filing a motion to reopen or reconsider a USCIS decision regarding your case. The motion must be filed with the USCIS Service Center that made the original decision. An explanation and evidence may be filed in support of your motion, and a fee must be included. but if the MTR is denied, is there a possibility that i can file an appeal? or if there is a denial i wont be able to do anything else?
