Any of you have experience filing a motion to reopen (MTR) form I-290A on a denied I-485 case??
If so, what are the receipts you get on filing and adjudication of MTR
1) Do you get a receipt notice with the receipt # of the MTR filing
2) When the motion is considered and decided, what are the notifications you get ?
- Do you get a notice of Action with the receipt # of MTR or I-485
3) When a final decision has been made, do you get a notice of action on
the MTR receipt or I-485 receipt ?
4) If the appeal is denied ( MTR) , how does the notification look like?
My I-485 w as initially denied due to lack of finger print and I had filed a MTR with substantial proof . On filing my attorney received a receipt of filing MTR. After a month, I received a courtesy copy of I-797C ( Notice of Action) with receipt # as the receipt # of I-485 filing, Receipt Date as original receipt date, notice date as Sep 14,2004 ( which is approx month from filing MTR) stating that the case has been re-opened. DId not hear anything from VSC afterwards. I had requested a change of address on my I-485 two weeks back and suddenly I receive a denial notice exactly similar to the denial notice I received last year, which I had appealed. There is no mention of the MTR or appeal in the new denial notice.
I am trying to figure out if the denial notice was in error or if it's the motion which has been considered and a denial been issued. Online status for MTR shows 'received.....' and I-485 says a 'BCIS motion has been received and case is pending '
Any guidance /inputs would be appreciated ..
