MTR - Approved
My I-140 is approved on 05/23/2005 (wife b'day) after I filed MTR/Appeal. My family's I-485 is approved on 05/27/2005 (daughter's b'day). I'm thankful to Rajiv Khanna for building and maintaining good portal. I've gained lot of information about the whole process from the members of this forum. I hope the good work gets better and many more people aspiring to immigrate to US will find this board helpful. Please find below brief history of my case.

Labor AD 03/17/2004 (After being remanded to state)
I-140/I-485 RD 06/23/2004 (Pure Concurrent)
AP 08/09/2004
EAD 08/09/2004
FP 09/10/2004
I-140 LUD 01/20/2005 and 01/28/2005.
Called attorney to check whether they recd any RFE. She said "No"
I-140 LUD 03/03/2005 Message changed to "Recd your response to ..."
Confused, I called attorney again. She was apologetic and told me that she forgot to tell me about the NOID on I-140 (Education). She hadn't sent a new evaluation, instead wrote a letter that employer has no problem with my education. Shocked at her ignorance, I prepared myself for denial.
I-140 04/18/2005 Denied.
I approached for a second opinion. Everyone told its useless to pursue the case. With another LC in Dallas BEC (PD March 2003), I didnt have any interest to file MTR.
05/17/2005 Late in the evening the attorney calls to find out whether we would like to file MTR/Appeal. I said I would like to but only if we get a new educational evaluation.
05/18/2005 Last day to file MTR. Got Edu Eval done in the morning, Same day courier to file MTR.
05/23/2005 I-140 Approved (I couldnt believe it!!!)
05/27/2005 I-485 Approved for the whole family.
I would consider my self lucky and blessed. I filed MTR as I didnt want to think in future that what would have happened if I did file it. We are very happy and eagerly waiting for the approval notices. I have taken Infopass appointment in Chicago on 06/14/2005.
