MTR and EAD Options

See my signature for details. Its been now more then 2 months and I have not heard anything about MTR from them. I have no clue what should I do. MY EAD will expire on 7/10/2005. I have applied for EAD but I think it will be denied as soon as they process it since my 485 is not considered pending right now.

Please suggest me all the options you guys can think of.

My is MRT pending from 4/7, message says 30 t0 60 days.

what was in your message?
 
Is your EAD expiring? What are you planning to do if MTR does not get approved. OR if EAD is coming to expire?

What are the options you have thought about? I am clueless what to do.

I don't know why such a difference.

Desiladka - My EAD is good for the rest of the year. I am going to fight my case in immigration/Federal courts, whatever it takes.
Applied for asylum, if they deny, it will bring me to the court no later than 6 mo from now, othewise I might be able to file EAD on the grounds of pending asylum aplication.( Of cause it's not frivolous).

Why don't you re-apply AOS/EAD?

its my suggestion...u can call VSC now...if someone nice takes ur call u can explain the situation and they might help opening ur file soon. we tried once and got it opened after a week or so....its just my opinion....think abt this...

You mean apply for a new 485/EAD? Can this be done? Would that affect my old 485 in any way?
 
No, it would not affect your old 485

Because it is inactive/denied right now.
You just check in the form that your had applied before and it has been denied and reasons for denial. I read on this forum that some pll got approved promptly after reapplying. Talk to your attorney or to a better one.
I am not sure about elligibility. But if yuor attorney can wrap it up you might buy some time for EAD.

Another option : go to Federal court directly. My attorney told me there was a precedent recently in Michigan Federal court. There is a question about jurisdiction, but remember that your AOS has been denied without right to appeale.

You can apply for EAD with your MTR receipt notice. As long as your MTR is pending most likely (depends on officer) they will consider your 485 is pending and EAD will be approved. Even if they deny the EAD, because of the current 485 status, when they reopen your 485, they will approve your EAD.

My wife’s EAD got denied in Dec-04, when her 485 got reopened in Feb-05, the denied EAD got approved even without appeal on EAD case.

That really brings hope to me. The problem is what if the EAD gets denied and the MTR is not approved/485 not re-opened. What while this time my current EAD expired (07/10/2005 current EAD expiry)

What should I do? I just want to make sure that I do the best that I can, and then god is great.

Now my MTR has been filed since more then 60 days. Actually 64 days top be precise. I am really very worried and upset. My EAD is also going to expired in 7/10/2005. I am really concerned whats goin to happen.

Anybody who has filed for MTR waiting for more then 60days? Anybody who filed MTR took them more then 60-65 days?
