Hi,

I filed for N-400 about couple of months back. Now, my company decided to move me to India for setting up shop there. I expect this will take atleast a year or so.

What will happen to me citizenship application during the time i am outside US ? What should i do ?

Same Problem

I have the same problem as you. I posted a similar question to this about a week ago. Look it up.

I understand that we must not be out of the country for more than a year to maintain the GC.

The problem in my opinion is with the "Physical resdence" requirement. we have to be more than half the preceeding period in the US (30 out of 60 months).

In th Guide to Naturalization" I saw that this requirement was only prior to application but being the paranoid that I am I don't want to take chances. They might also expect it to be maintained throughout the whole process.

In any event, make sure you have someone to pick up your mail, and try not to be out of the US for more than 6 months at a time (otherwise you will need to give a lot of explanations - that you have not severed your ties with the US).

If you move overseas then your can forget Naturalization and your Green Card. All overseas trips must be temporary.

If you have to go, make sure you are back in 6 months or less, maintain ties to the US, pay US Taxes.

It is also advisible to to not move permanantly overseas for about one year after Naturalization. There is a now obsolete directive in the INA specifying de-naturalization criteria if you quit the country immediately. Just like its a good idea to not change jobs immediately after GC, its prudent not to immediately pack and move after Naturalization.

If anybody can verify it with dokument citation or this is just some informal rule?
