Moving to India before Processing complete at Buffalo

Hi Friends

What happens when we apply at Buffalo but have to leave to India (H1 6-yr expiring without Greencard) ?

- will they transfer the case to New Delhi ?
- do we have to start from beginning ?

I am not sure if things have changed but some one we knew moved to India and then got the request for passport after having started it in the US, what helped them is that they went through lawyers so the address remained the same and I guess the buffalo consulate doesn't need to know that they moved to India since they only correspond with the lawyers, once the processing was complete the lawyers mailed the passport to india and they landed from india
 
Thanks much Srini88. This seems like a good idea to have the lawyer's address. How recently did this work out for your friends. I am thinking this will still be a problem if one has to attend the interview.

Couple of points

Hi

1) You dont need a lawyers address. You can also give one for friend/family who doesnt move houses often and stays in the same place.By the way it is illegal to mail Indian passport over international borders. Ideally you can get a fried/relative to personally carry it for you with your authorization letter.

2) If called for interview you can try to come on tourist visa. If you cant get US tourist visa than its a gone case. You can fax and ask them to transfer your file to New Delhi but that is totally up to their discretion and could be lengthy.

In their case this was back in 2000, regarding tourist visa issues one of things that some lawyers suggested is to have the case transferred to the carribean since I guess it is easier to enter there than the US even if there is an interview scheduled it is easier to enter there, you might want to confirm this though if it is possible, they told me this was possible in 2001 not sure about this now
