Moving to Another state and new job

Gentelmen,

I am moving out of the TSC area to NSC area.
I am on EAD and changing employers infact the change is due to
a lay-off.
FP has been done on 05/03.

What should I do:

I need to fill a AR-11 form and inform BCIS about the address change. What else??

DOES MY CASE GETS TRANSFERRED to NSC??
And What happens to the adjudication process??

The "LongGC" case denial is giving me a nightmare.

I believe once you file for AR-11, your case will be transferred to NSC. The chances for RFE for transfer to NSC are slightly higher.
But it is anyone's guess.
You might want to post the same message in NSC board.
I think you will have to file AC-21 , i dunno whether you shd file it right away or wait if RFE gets issued.
How long were you out of job? If your new salary & job profile is
close to what you had in your LC, then even if RFE is issued , you should be fine.
I assume you don't have attorney but in case if you do, can you please share with rest of us your Attorney's thoughts.

I was out of job for about a month before I got this new job offer.
My 180 days after I -485 were over when I got laid off.

the salary and job functions are the same as in the LC.

My Lawyers are absolute unconcerned about this.
I am afraid about getting the RFE.
I am also hoping that my previous employers do not inform the INS,that I do not get a I-140 revoked.
Can the previous employers get a I-140 revoked after the 180 days.

incase of longgc he had his 140 substituted due to a take over and then was laid off.
probably tsc as usual has not seen that his 140 has been substituted and assumed the worst and send him a denial. i am sure if he meets a good attorney his gc should be there anytime. as far as you are concerned change of address outside jurisdiction will definetly give you a rfe which is not bad,...if you have all other documents in order

Hello "endless-journey",

Filing the AR-11 means, you informing BCIS/INS about your physical location and it got nothing to do with your GC process. Everyone (including green card holders) other than US citizens have to file AR-11 when they move to new place.

In order to change your correspondence address with your GC process, you or your attorney has send a letter to Service Center to change the address. Filing AR-11 will not change the address on your GC application and it just tells BCIS about the physical location.

Regarding AC-21, I don't know what is filing AC-21. AC-21 is provision that allows any 485 applicant to change employer with same job responsibility and same or high salary. For my understanding there is nothing to file AC-21.

Some attorneys says, send a letter to inform INS that you no longer working for the company that is sponsoring your green card with some explanation about why you are changing employer. Some attorneys says wait until receive a RFE, so that we can answer the RFE at that time.


The above mentioned points that I knew from my attorney. The guys in this forum are better than me and can give their experienced suggestions.
