Moving from H1B to EAD

Hi,

I am currently working on H1B. Now I am offered a permanant position and I am planning to use my EAD (I got it as a secondary applicant using my husband's labor). Could someone tell me the procedure to convert to EAD from H1B?

Also I still have one and half year validity on my H1. Can I still retail my H1 while I work on EAD.

are you saying you are dependant on your husband's GC processing or did you mean you used a labor filed for you husband and now a primary applicant? reason being if you are a primary applicant you might need to file for AC21 if you want to work on EAD and your H1 will be invalid. if you are a dependant then you dont have to do anything but jsut use your EAD and change job.

But any case only one status can be valid at any given time. Either H1 or EAD, not both, but you can switch to EAD from H1/H4 anytime but reverse is not true always.

To switch to EAD, you need to go to HR and show them EAD, and fill a form (I-9 I think), your H-1 becomes invalid since the day you start using your EAD.
