Moving for faster processing times I-485

My mom recieved her Greencard in July 1999. She filed form I-130 for me and the priority date is August 1999. She just recently became a US citizen and is going to upgrade the petiton.

Here are my questions:
1) Does family based 485's take as long as employment based? Or are all 485's are considered equal and first come first served?

2) In NYC, I see that the processing times for the NYC office is almost 2 years, Is it worth it to move to somewhere like Virgina or Washington where the wait is only a year?

One cannot upgrade I-130 petition if mother is applying for unmarried child as an LPR. Your mother will have to file a new I-130 for you.

1) It depends on how long your FBI name check takes and how you file your family based AOS. I think employment will be faster if you are filing as a child of a USC.

2) I am not sure...I encourage people from that area to answer this question. Again, take FBI name check wait into consideration if you were born in any of the US terror watch list countries.
 
I am pretty sure my mom can upgrade the petition, because currently I am in the F2B category and when she becomes a citiizen, my lawyer states that we can upgrade and file AOS.

But can anyone from VA or Washington chime in to see if it is worth filing in those states rather than NYC
 
My mom just became a US citizen, and is in the process of upgrading the petition. I have not filed the I-485 yet. Anothe question I have is:

Do I have to file that change of address form AC-xx if I only have the I-130 in and NOT the i-485?

First of all your I-130 can be upgraded by your mom sending her citizenship certificate along with your recipt number to NVC or your service center where you file your petition. If your petition is not approved then you should send these documents soon so your petition will get some speedy work. As you told your priroty dates are August 1999 so your visa number is current. Secondly Family based visa and Employment visa are two different categories so 485 depends your visa category. But both of them have same time, Some time happend. Its depend upon your documents as well as FBI name check system. So if you get some speedy work and if you have all paper work done then you'll be very close to your Green Card.

thank you for responding. I hope you're right. Even thought the local processing times in NY District Office is at Dec 2003 for I-485's. When I file mine this year(2005), won't it be 2 years waiting for them to get to my 485?

That's why I asked if all 485's are piled into one. Because I know there's tons more employment based 485s compared to family based. Any one have any ideas?

Cheetat1, I don't know why I automatically assume that all people in F2B category get married before their GC is approved. Well, I need to think outside the box!

Your visa number is curret so you should not have any problems applying for AOS.

Also, Employment based and Family based visas have no connection. Both go through separate process.

There is a pilot process in Dallas DO where you can get your GC in 90 days provided you clear your FBI name check. You may want to look into it. However, there is a 2 - 3 month wait just to make an appointment.
