Moving back to United States from Canada with Canadian spouse

Hi everyone,

This seems like a great forum, I checked the archives, and couldnt find what I am looking for..Hoping you can help.

My wife and I have been married for 15 years. She is a US born American Citizen. She moved to Canada when we got married and we are now looking to move back to the USA. I have been told the process is pretty simple for me to establish status and residency. However there are some legal and paperwork and can take a few months.

My question is what and where is the best place to start the process. Should I start here in Canada before I enter the US, or start when I am there? Also as a Canadian Citizen I enter and exit the USA all the time. However when making the move, can I drive a truck with some boxes across border without causing concern from border patrol? I want to do this all legitimately and not hide anything .

We do have an established address in the USA with her parents, not sure if that helps.

We also have two kids 10 and 3 , I have been told their status is automatic and we can get a US passport here in Canada at the Embassy, in a couple of weeks.

Any help and advice is greatly appreciated.

The proper process for someone outside the U.S. is to go through Consular Processing -- she would file I-130, and after that is approved, it will get transferred to the U.S. consulate in Canada, and you will get an immigrant visa there. You could theoretically still enter the U.S. for temporary visits during this time, but there is a chance you might be denied entry, if they find out you are immigrating.

Yes, the kids are U.S. citizens and they should get U.S. passports at the consulate.
 
For the kids, you will probably apply for both a Consular Report of Birth Abroad (CRBA) and a U.S. passport for them at the same time.
