Move on Preapproved labor.

I filed my Green Card processing with my Current employer in June 2005 in PERM in EB2 category. My Priority date is June 2005. I got my approval in July 2005. I filed my I140 & I485 together in Sept 2005 as priority dates were current at that time. My I-140 got approved in December. I am currently on 3yrs Extension on H1-B because of I-140 approval. When I filed my 140 & 485 together, I was single. I got married later and as priority dates regressed I could not add my wife’s name in my processing. I have to wait till Priority dates become current.

There is other company that has pre-approved labor with a priority date APR 2003. Current priority date for EB2 is Jan 2003. Its just 2 months later. I would like to use that Pre approved labor so that my case will be opened sooner once Priority dates shifts to April 2003. Only reason I would like to do this is this will enable me to add my wife’s name into my processing once priority dates become current. My wife is a Doctor by profession. She is going apply for Residency later this year or early part of next year. If she is on EAD then she has more options to choose from as most of the hospitals don’t provide sponsorships.

Questions:

1> How safe this is to do?
2> What all information should I gather regarding this company? As I don’t know anything about this new company. If I am interested then I will call them up and ask few questions to check out how this company is.
3> Is it possible to ask new company to start processing my H1-B and I-140 before joining them and once I-140 gets approved then I will switch. This way I can minimize my risk.
4> If I move to this pre approved labor and priority date becomes current, I will add my wife’s name into my processing. How soon she will get EAD and how soon she can work on EAD once I add her name into my processing.
5> What is your advice to me in this situation? Should I take this new pre approved labor?
6> Any other things I should consider?
