On june last year i had a I-130 interview wich we missed.. it was uscis mistake cause they send the letter to the wrong adress.. we had proof that we changed our adress.. so they took the case to court. we went to court for about 4 times until the judge agree to allow us to fill a new I-130 ... and gave us a new court date. wich was this year on february... I got pretty sick that month and couldnt go to the court date. so the judge sent me a letter with removal proceedings explaining that i didnt go to the court date and i had to fill an application called "Motion To Reopen" wich we did with our lawyer. explaining i was sick and couldnt show up... now i got the I-130 Interview this june 8 but i havent get any answer from the court. what should i do cause my lawyer told me i could get arrested at the interview ... i mean i feel very confident that my marriage is real and i been married for over 5 years i came legal to this country and i know i will pass the interview. i am just scare i will get arrested. i would appreciate someone oppinion about this case.

No offense, but you missed it because you were really sick? Even if I was dying in hospital, I would not miss it. I'd take a barf bag, my IV, and a nurse if I had to, and trust me, I've been truly ill before, where I was hospitalized, but would not miss it.

There is nothing you can do, you missed the court date which it a HUGE no no. It's the best way to make a judge mad and not want to help you. It was a really bad move and because of it, you can't do much.

well if you were "soriously" ill, you definately have some prooves of that like hospital visit, medication prescribed etc. give to the attorney he could try to build up a case to prove to judge there was a reason behind not showing up. a real reason.
