I have a question regarding my mother filing a petition for me. First here's some background information. In July my mother filed for Adjustment of status under 245(i), based on an approved petition, that was filed on her behalf by my aunt back in 1993. I on the other hand, "age-out" by turning 21 several years ago, but as I understand it, I'm considered to be a derivative beneficiary of the original petition filed by my aunt, and this entitles me to the benefits of 245(i).
My question is, if everything goes as planned, and my mother receives her green card, can she file form I-130 ( Petition for Alien Relative ) and forms
I-485 & I-485A ( Application to Register Permanent Residence) concurrently on my behalf? Thanks in advance for any help.
Here is my mother's timeline:
Mailed forms I-485, I-485A, & I-765 to Chicago Lockbox - July 1st. 2005
Packaged received July 3rd
Received NOA for I-765 - July 19th
Received NOA for I-485 & I485A - July 20th
FP appointment Sept. 6th
Received EAD approval notice via e-mail - Sept. 7th
EAD approval notice mailed Sept. 9th
EAD card received Sept. 13th
