The details of my case are as follows:

VSC, regular processing
Receipt date: 5/16/06
RFE date: 11/2/2006
Future ???

My company sponsor’s lawyer says that he has never seen and RFE so demanding. They require four new things, one of which is very difficult. That is, to demonstrate that a Bachelor degree for the position that I was offered is usually customary in the industry. They suggest that we submit pertinent job postings for the specific industry, or maybe statements from similar companies saying that they usually require Bachelor degrees for positions similar to mine.

The other three requirements are manageable, but this one is a killer. The lawyer says that USCIS must suspect fraud or something, because he has never seen an RFE such like that.

Does this mean that my case will be denied anyway? I cannot help it but I feel desperate. What is the approval rates for applications with RFEs?
Has anybody else gotten a similar RFE?
Please share your experiences. I hope that easies my anxiety.

Got approval!!

For the benefit of everybody, we approached the RFE from different fronts:
1) Obtained letters from old college professors saying that they thought that a degree was required for my job position;
2) Obtained a letter from a professional association saying that a degree (at least bachelor) is usually required for my position
3) Printed some job postings similar to my job position that clearly required at least a bachelor’s degree
4) Switched to Premium Processing to get a more experience adjudicator to look a the case with a fresh pair of eyes.

Everything worked out. Got approval notice 27/Dec.

Good luck to everybody.
