Hi,
My wife and I are both on independent H-1 visas and only my company is ready to file for GC.
problem: The name on my wife\'s birth certificate is "B. Arathi Shenoy" The B. referring to her village initial and Arati being spelled as Arathi. This is the only place her name appears like that. In every other document (US and Indian school certificates, passport, visas .. everywhere) her name appears as "Arati Shenoy".
We haven\'t changed her name after marriage in India recently. But the marriage certificate was issued with her birth certificate name "B. Arathi Shenoy".
I have checked with the govt offices and lawyers in India and there is no way to change the marriage certificate.
Will we have problems in her applying and getting GC in the name of Arati Shenoy as my wife since the birth and marriage certificates say a different name?
(her parents in India can swear to the effect that birth name registration was wrong)
Should we get married again here in the U.S. ? (Won\'t that be illegal ?)
What should we do.. please advice ?
