Hi, guys,
I am new to CP, and would like to learn more about it. I am still at the begining of CP (not started yet). I was looking through the CP tracker page and noticed that most of the cases got established in NVC within one month of I140 approval. I just wonder whether all of them indicated CP on their I140 or whether they switched from 485 to CP.
As I need to switch from 485 to CP, I wonder now how long does it take for INS (TSC for me) to transfer my I140 approval information to NVC and set up a case in NVC once TSC receives my I824 (I suppose I should send I824 to TSC, right?)?
In addition, I have the impression that once CP starts, I485 is withdrawn. But recently I saw people saying you can still keep I485 application while doing CP. Which one is right?

Thanks a lot.

o It is highly unlikely that AOS to CP cases would take 1 month after 140 approval to get established at NVC.
o It takes anywhere between 6-12 mos. Browse through the forum for specific info. to your SC.
o Read Rajiv Khanna's note below the link to CP forum in "Immigrant Visa" page.

Answer: Since you want to change from AOS to CP you have 2 options:
1. AC I-140 route based on I-824 receipt
2. File I-824, wait for I-824 approval and then traditional NVC route
1 or 2 above depends on your consulate. What consulate in your home country do you belong to?

Answer: 485 is terminated when the letter sent by BCIS is signed authorizing change from AOS to CO which currently is taking upto 1 year depending on service centers. Until that point AOs and CP runs parallel.

AC140

Thank you very much for your information. I will submit to Guangzhou, China. However, I am not really sure whether they still accept AC140. From http://www.immihelp.com/gc/consular/ac140.html
Guangzhou may still accept AC140, but I don't know this is how long ago. I have read some thread in Yahoo China CP group that Consulate in Guangzhou will just ignore your AC140 and only accept cases processed by NVC. Here is one information in their website:
"The U.S. Consulate General in Guangzhou receives immigrant visa petitions only after required processing is completed at the National Visa Center. When the files are received, the Immigrant Visa Unit requests pre-interview clearances. The case is then scheduled for interview after visa numbers are obtained for preference categories."...
http://www.usembassy-china.org.cn/guangzhou/iv/gz.html
I think if they say this in their website, that means that they don't accept AC140 anymore, right?

In addition, I have not heard any AC140 case in Guangzhou recently. It would be great if you have such information.
I also plan to call Consulate in Guangzhou, however, this may need patience and luck.

One lawyer just suggested me to do "third contry national", I have no idea what that is and if it is relavant to me.

Thanks again.

I am afraid i have also heard and read postings that Guangzhou, China does not AC I-140 process.

As far as TCN you will find a lot of information around this on this site if you use the Search functionality. All the best!
