hey guys, i just got 3 paper noa's (i-130, i-485, i-765) and found out that my wife's date of birth on i-130 notice was incorrect. i have checked the actual i-130 form that was filed, and indeed i made a mistake with her date of birth. i have contacted uscis using the phone number provided on the receipts and they told me that my case is being processed with national benefit center in MO and created a request to change her date of birth info, also gave the confirmation number. so the question is what will happen next? will they send me the submitted i-130 back? or just have to send them the corrected one again? and will my case be delayed because of that? thanks!

oh, my wife is a petitioner, i'm an applicant/beneficiary

If the date of birth is correct on the I-485, this I-130 issue can be handled at the interview. Make sure she brings her birth certificate to the interview, and you should remember to explain the error.

But if the I-485 date of birth is incorrect it's a bigger problem because the I-485 DOB is used for background checks.

Yes, the issue can be handled at the interview if it is not resolved before then, although it is best to correct this error in the initial stages of the process. This information forms the basis of background checks and could result in more detailed scrutiny of your application especially if you have listed her d.o.b incorrectly on all forms submitted, listing her d.o.b. incorrectly on just one form can be attributed to carelessness, all three is another matter. It does not however mean that you will not be approved.

Be prepared for lengthy questions on your relationship with your wife, as in establishing that your marriage is a bona fide one. Begin gathering convincing supporting documents over and beyond to this end.

Good Luck.

just checked the submitted i-485 and her date of birth is correct there.
so i guess we will leave it as it is and explain the situation if they ask us about it during the interview. maybe they will just update her d.o.b while processing those forms since i've already called them

Don't wait for them to bring it up. If they discover the discrepancy on their own after the interview, it's going to take longer to resolve.

So you need to bring it up and explain the situation in the interview, and show her birth certificate to substantiate the correct date. Remember to emphasize that only the I-130 has the incorrect date, and that the I-485 date is correct.
