I filed a 485 concurrently a year back, withdrawn both I140 & i485. Refiled I140 after sometime. Upon approval of I140, 485 was filed during july 07 fiasco.
It has been a year since I refiled 485 and now my case is transfered to NBC. When I went back and cheked the filled 485 form for the question 'have you filed any i485 before?', I have answered 'NO', thinking that i485 is withdrawn (assuming no decision was made) and need not mention that. Me and my lawyer thought the same way. Could this be the reason for my case being transferred to NBC. Can this be rectified by any means? Please help. !
