Hi just wondering if anyone have an answer for this here is my friends situation, he had a misdemenor crime that he could remember was back in 1997 he went to the court where he was fined and found no record of it then he went to the police station where he was arrested no record he filed a foia with the state police no record he wanted to expunge it, u think fbi would have a record of this it was a petty offense nothing major, he filed 485 a year ago and no answer yet can that be a problem for him.

What was that petty offense and/or crime? By 1997 the goverment didn't have all the new databases that they are using right now, it depends in the type of crime you are referring to. If it something at state level will stay there if it's something involving a federal crime should appear at the FBI database.
Now, his problem could be not exactly that he had a record somewhere or none, but if he put "no" at the I-485 in the part "if you were arrested before for a crime..." and then they found out a record.
What type of resident permanent based is he? family, employment?

thanks for replying but my ? is if u had a record wouldn't it show up at the circuit court u should be able to get a disposition right if u wanted to get it expunged or sealed, by the way it was state level crime nothing major and he did mention it on the i 485 that he was arrested and he is family based aos, he just wants to get it expunged and according to an attorney u cant do that without a disposition.
