Misdemeanor charge and citizenship application

Hi all,
Hope you can help. One of my very good friends had a misdemeanor charge against him (which was dismissed in court later, and the charge also had a citation(???) for less than $ 50) This happened around Oct 2001 just when he got his GC. Now he wants to apply for c'ship, but does not know what to do. The c'ship application clearly says that even if a judge has said your case is dismissed, mention it here.The records of his charge, he was told would be destroyed after 3 years from 2001. DOes he still have to mention this in c'ship application or just leave it.

ANyone with similar experience, please share.

Depends on the class of misdemeanor.
Most driving offences are Class C misdemeanor...so unless you have a huge amount of them you won't have a problem for citizenship.

Regardless of the outcome of the case, your friend has to mention it in the citizenship application and be ready to prove with the court paperwork.

If it was a class A or B misdemeanor, it might be a problem....when your friend says the case was dismissed...does that mean he was found not guilty??? Or was he given a suspended sentence or probation of three years.

If he was found not guilty..then there is no problem for citizenship....if it was anything other than not guilty he needs to contact an immigration lawyer.
