Mirriage on a US citizen while waiting for final divorce from an ex

Hello guys. I am new here and i am loving this forum. Although i didn't really know if this is the right forum i am posting this question. Basically, I was married with a guy that petitioned me to come to USA. And when i got here in May 2002, he filed I-485 and I-130 for me. So i got my work permit and had my passport stamped (I-485 filed). In February 2003 my husband left me. We didn't get along and we both agreed not to live with each other. (boy that was really hard for me and i cried for about 1 month just to get over it). So we are basically separated with me left alone and my I-485 pending in the INS. A few months after he left, i met another guy and i fall inlove with him. We are planning to get married this Valentines Day (Feb 14 '06)in las vegas but my final divorce papers from first husband that left me wont be on my hands until April. If i get married this month would that be considered polygamy with immigration law eventhough the divorce has been filed and just waiting for final decree? I mean will the immigration honor my recent mirriage and can my 2nd husband repetition me? Thank you so much and i would greatly appreciate any comments and advice. GOD BLESS all.

I hope you did not get married yet. You are not considered divorced until it has been finalized and you receive the final decree. If you did get married...it is not immigration law you violated. I believe polygamy is outlawed in all 50 states....it has nothing to do with immigration. However, Immigration will not consider you married to the second husband...because you were married to the first husband at the time and were ineligible to marry the 2nd one.

Not to scare you but I would consult with an attorney immediately. This goes beyond immigration...
