Miracle approvals post here!

Hey, I've heard of couple of cases that have been approved despite PD's .

I know it's puzzling but at least we can hold on to something even as rare as a miracle.

Please post if you are one of the lucky ones or have heard the same rumors.

There is hope and there is "Reality". Hope is something we can always have and nothing or nobody will change.
Reality is something we need to be aware of, and most of times there is nothing we can do to change it. Just accept it !!

Like this freaking CIS system !!

These are the two possibilities:
1) As evident from your resident since date, you might have been approved last June when visas were available and USCIS forgot to inform you at that time.
2) USCIS approved your case now under worldwide category by mistake and put the June2005 resident since date to cover up their mistake :)

Either way Congratulations!
 
thank you Dallas03096. So far, you have the most reasonable sounding guesses. none of the 5 different lawyers i spoke to, could come close.
cpl. of them scared me. They want me to write to TSC and ask them to cancel the approval and get back in line on H1.

Your key may lie in "Category" of the Plastic Card.

Can you kindly verify the "Category" in the Plastic-Card? Usually you will receive an I-181/I-797 with your Plastic-Card. You will need that for the future. Did you get it? Is your address updated? Else, you can file an I-824 to get the duplicate approval notice. That will give you a clear picture of approval date.

I guess the following plausible scenarios:

  1. You got approved as EB2 (Under category something like "E26" for you and "E27" for your wife????) on 03/06/2006.
  2. As the other friend had said, you got approved on 06/30/2005, but the entire file was not closed with the follow-ups they should have done after approval,at which time all the records tethered to your A# indicate that you are an LPR. All they did from June 30, 2005 to March 06, 2006 was to update the system with the post-processing of an approval and issue a notice and/or a plastic card.
  3. They did approve your petition only on 03/06/2006, but under EB2 category. Seems like you had a US degree and may be they might have approved under that category as those dates are past your PD.

I wish i finished my masters. But no, I'm one of those grad school drop outs with a ton of debt and abysmal GPA, < 2.0 :D , from living large. some lessons hard learned but fun when u look back.

From the discussions we have had, I bet dollars to doughnuts on your approval date as 06/30/2005. Now, I think this post-processing is what didn't happen in your case after 06/30/2005 that had put your application in limbo. Somebody, on audit, looked at it and have done the right thing. So, I don't see anybody in error here. I don't even think this is something like TSC screwed up. Rather, they just took more than 9 months to do the post-processing, while in fact, they should have taken no more than 15-30 minutes.

Miracles or Mistakes

what are the consequences of the miracles. Are they good or bad for the lucky ones.
What if USCIS finds out later that they gave the approval in error.
 
i pm'd Aryabot to see if he has any information on ramifications and implications. Havent heard back yet. Hope its all good and they wont take it back.
