i am on h4. i came to us 2000 aprial. my h4 is (I94) experied
on2000 july. i have small babey monthes old. i don't know
h4 statues at that time. we applied h4 onfeb2001. we got it .

but right now 485 ref what is your statues from july to feb????
could u tell me act 21.
 
Yes you were out of status. Your I94 should always be in current state on H4 . You should hv filed under section 245 for your 485 along with 1000$ Or chances are you will get denial or more problems. Contact good lawyer .
 
Or, is H-4 similar to F-1 (student visa) where at the POE they stamp it as D/S (Duration of status). Since H-4 is intricately linked to and dependent on the spouse's H-1, would the holder not be in-status, the moment the H-1 is renewed? The stamp on the passport should matter only if you are moving through the port! Or, so I thought ...

I am on H-4 visa and my visa expires on Dec 30 2002, my husband got his new H1 B visa (changed his company) which is valid till Feb 2005 and is in status now. Is it true that "H-4 nonimmigrant alien (Myself) continues to remain in valid nonimmigrant status as long as the principal alien (my husband) remains in a valid nonimmigrant status".


A203 As long as your H-4 I-94 is valid AND your H-1 holding spouse is maintaining his status, you are in status. His change of employers does not affect you.

In your case u did't extend the H4 for a valid I94.does't matter u changed the employer or not.so you were out of status.
