Messed Up: Divorce and AOS

I desperately need an authentic advice ASAP.

Jan 2001: Entry from Pakistan into USA on F-1

Mar 2001: Dropped the classes and due to not knowing the exact law became out of status

Apr 2001: 245i submitted along with AOS application; INS finally denies the AOS stating that the AOS application was not recieved.

Dec 2001: Finally collected the evidence that I had applied for AOS that include the follwing:
- Post office certification/recipt/certified mail.
- Checks written in the name of INS that were attached with the corresponding applications and that were cashed/collected by INS by getting bank statement.
But the date to appeal on INS decision is already over

Septem 2002: Married a USC

Nov 2002: Filed for AOS and GC/PR

May 2003: First interview; INS not satisfied; opted for a re-
interview; not heard about it so far. Spcial registration done.

Oct 2003: No longer wish to stay togather mutually decioded by the couple.

Question 1: How fast can I get a divorce if we have no kids, no assets and no loans....

Question 2: When will the INS know about my divorce?

Question 3: What are my options now?

Question 4: If I become sucessful in finding another girl /USC
before I file the divorce, Can I marry her in the marriage hall right before getting the divorce from my first wife or Should I get a divorce form my first wife and right before notifying INS about that marry another USC and file instantly for AOS/PR. Note that I did every thing I could to save my first marriage.

Or what are my options?

I need more info

Ok, now I understand that I can get a SUMMARY DISSOLUTION and I qualify for that, still I need to know that:

- As the divorce will come into effect 6 months after filling. How much time/grace period will I get after being officially declared divorced to decide for myself whether I want to stay in this country (Marry another girl and file the papers through her) or when will the INS order for my removal etc. Should I do all this by myself.

Confused

Some one told me that a friend of his was in the same situation as mine. He was married to a USC and the relashion ship was not going well and he was not even living with his wife for more than 6 months or he even did not know the whereabouts of his wife and he without getting a divorce from his wife married another girl and and when he was asked by the authorities (I am not sure whether the INS or the court but I think he meant INS) why you married another USC without filing and/or getting a divorce, he said that I did not know where my wife is for a long time....... That guy was also an applicant for AOS rthrough his first wife and he was waiting for his second interview cause the INS was not satisfied with the coulpe.....

Is that true????? :confused: :confused: :confused:
 
6 month is not a long time. He might go to jail for bigamy. Don't don't do the same.

I believe that your are wasting your time by trying to find legal information here on this board. You need to talk to a family lawyer and an immigration lawyer.
 
According to your post, you are not qualified for AOS period. The movement you devorced
either side you have no ground to stay in this country at most 9 days if I am not wrong
before you leave this country.
In your friend friend case - the officer was not sure what he was doing, may be not informed (im) properly.
Well you can find another (aos fish) girl but you know out of just desparation you wont get right life partner that avantually lead to
divorce in realality in a matter of time in this
country. If this fake business is known I dont
know about you but the *USC* has to face
a big time with government in this kind of
environment.
 
This "marriage for money to get gc" is a big business. These are kind of the people who defame the whole country. Another type of people are who somehow manage to get 6 month tourist visa and never goes back. This is the reason it is so difficult to get a simple tourist visa for legitimate people.

The other problem is this crapy polititions encourage to get more illigals into this country. Look at california ther are trying to reward criminals who broke the law by giving IDs to all illigals, its great that the new governer revoked it. If you look into illigal migration is skyrocketing in all south western states.
Dont you think it makes you feel "legal immigration" is a big joke.

I still remember before 1998 lot of people from pakistan come here on "asylum"
these idiot gov. official put them directly in 5 star hotel (I mean 5 star hotel) for a while at the expence of hardearned tax payers money. These m*f enjoy in 5star hotel and look for a temp. job to get into this country and become as *USC* I strongly believe they evantually suck from social benifits as much as they can and become burden indirectly. Well what do you expect from this uneducated unethical who starts life with a big lie in this country.

Few months back I was watching german channel, accordign to the latest stats. there has been a lot of migration going for last few years from Arab countries to different parts of Europ, 80% of these people endup relay on social benefits in the log run that makes lot of Europen countries to think about immigration.

How can INS deny AOS stating that they never received the application?
If INS never received the AOS application, there is nothing to deny!
