I have a question for you. Philipines and ROW moved forward in EB-3 by one year. In your experience with handling cases and regular contacts. Do you think EB-3 india will not advance much this year or fiscal year 2008?

Can it move by few months atleast? Is it going to be like this for a long time?

485 approval can be done in 25 days.....(i have painfully seen couple of EB1-india folks getting that speedy approval in Sept 2006)

it can also take upto 3 years...if you are stuck in name check....

on an average i can say...that 90% people get it done in 18 months (including namecheck)...

Time it takes for 485 Approval

Assuming that the dates are current, how much time does it take for a person to apply 485 and get a greencard in hand?

Is 485 processing fastest in EB1, slower in EB2 and slowest in EB3?

Historically it takes anywhere from 12-18 months for 485 approval after being current. As techy right said, 90% of cases fall under this category. The remaining 10% get stuck in Name checks and/or local office transfers followed by in personal interviews. Both these are very problematic and there isn't much recourse.

Name checks have been known to delay adjucation by as much as 3 years and local office transfers can also delay an application by as much as two years.

So long as you are part of the 90%, you will be fine. If you are part of the 10% then you will have a long and prodcutive or counter productive life in this forum :) :)

WELL SAID....485 approval has a black hole of namecheck...if you don't get caught in this hole...approval should be fairly fast ...6 monhts....

If you get stuck in namecheck...well, 1.5 years to 5 years...pick your guess in this range! HEE HEE!
 
I know somebody in EB2 ROW who filed I-140, 485, EAD, and AP all in January and got all of them approved including the green card by early March. Of course, the way USCIS works at random you can't predict the timing of your own case by looking at anybody else's, even if they are in the exact same situation as you.

My PD becomes current in May ... my optimistic prediction is for the 2nd fingerprinting in June, followed by GC approval in July. My pessimistic prediction is to get stuck in name check or some other random slowdown, and have to fight the FBI and USCIS and eventually get it approved in late 2008. Reality probably will be somewhere in the middle.

My PD is July 2001 EB-3, what are my chances I am yet to file I-485.

What are the chances of EB-3 India to move by two months or so?

UN, i have filed a EB3-china at the end of last year when my pd became current. Before that as I was devasated, i started working on eb-2 perm. We filed it this year and got it approved in one week. Now do you think it is worth all the money to file a eb-2 in case china eb-3 might reg. again? Do you think it is a good chance for that to be happening? Appreciate your input. Thanks!

o.k. a follow up question ..what causes a person to get stuck in namecheck (I know it sounds like a silly ques) ..is it that if I have a name like charles sobhraj then I will get stuck ? does it depend on the country of birth etc ?

mainly LUCK (unlucky) or sometime to do with ur name and nationality

One of my colleagues joked that it is better to be bi-sexual. Reason being that when you go out at night; you have double the chance of picking up a date (reason being that hetrosexuals will only have chances against 50% of the population; whereas bi-sexuals can go for 100% of the population).

Therfore; you double your chances with having eb2 and eb3 with same priority date. EB3 could become current but may be susceptible to retrogression again.


Not exactly..Your colleague is right, (100% chance to pick a date) only if entire population is bi-sexual.

I keep hearing the name check durin 485 stage. Can someone shed some light on this so called "name check" or any URL would help? Do they pick up people randomly to be sent for name check or every one had to go thru this check? Thanks in advance.
 
Priority Date Question

I have already cleared the I140 stage in EB-3 Category. I want to apply under EB-2 Category through the same company.
In this case, can I use the old PD (Priority Date) from my EB-3 Category?
