I am in desperate need of your help regarding "Name Check".
Since, I could not "PM" you, I opened this thread.

I received email from FBI Name Check that my Name Check is pending.
I need your help to identify the process to expedite the Name Check.

1) Send FOIA(Freedom of Information Act) to FBI(By regular mail). I sent by regd.

Sample :

100% you will get with "No Record". You will get this reply by regular mail in 2-3 weeks.

After that you write a letter again to David Hardy attaching this letter as a proof, and send by regular mail. It will take 2-3 months. I started this on September 9th 2004 and got cleared on December 20th 2004. You will get it.

What if

your FOIA request turned up positive, i.e., there is a hit for you in the FBI database, what happens then? You send the response back to Hardy and he sees it and says, yeah, right, FOIA me, now you are back in my hand, what do you do then?

I could not understand your question very well.

As I understood what happens, if it is +ve?

They will do diiferent ways of searches, and may give the file to special FBI people to go in depth. That time only Criminals will get cought. If we don't have any criminal background....no problem...Otherwise, I don't know what happens....

For all these things, it will take 1-2 years. i.e. the delay to most of the people. Lack of manpower to FBI, and especially big, and similar names for Indians.....

To expidite the actual Name check...FOIA, and FBI name check are 2 different sections(Even though both are in FBI, and head is the same person) will handle. Ultimately you should get clearence from FBI name check...

My Pd is 08/03 and my ND is October 04.

Not sure on average how long the FBI name check is processed. Not sure when the USCIS will initiate the name check process.

Do you think it will benifit us in overall processing if we personally send such kind of request to FBI , so that they will have our name and details with 'No record' in their database. If uscis request the FBi name check it might take very short time right.....
