Medical RFE

We received our RFE's from the INS today. According to the INS we have to redo our medical examinations, since they are older than 2 years!!??

Has anyone has a copy or a link to the USCIS memo stating that the examinations will be valid untill the I-485 is approved.

Any help would be apreciated.

01/16/2004: Validity of Medical Exam Report for I-485 Filers

As part of I-485 filing, the applicants are required to file a sealed immigration-designated civil surgeons' medical exam report to the USCIS. The medical report is supposed to be valid only for 12 months. However, as affected by the delays in adjudication of I-485, the former INS adopted a policy to extend the validity indefinitely until I-485 was adjudicated. It was released in the form of Memorandum. The Memorandum expired this month. Considering the continuing backlog of I-485 adjudications, the U.S. CIS has issued another memorandum to extend the policy for another year and until January 1, 2005, according to the AILA. Accordingly, those who have filed I-485 more than 12 months back do not have to worry about taking another medical exam and filing a new report at least until January 1, 2005.

It does not make any sense. Most people who filed in May, June, July, Aug 2001 - all of theirs medical is more than 2 years old. I don't think people sent new medicals to INS.

What is the exact text of the RFE ?

I would talk to INS and find out the reason. ( I don't know if that is a possibility or not).

How long did it take to get the RFE in your hands ?

I just got the information from the legal assistant at the lawyers, so I can't tell the exact words. I will on Monday speak to the lawyer personally about the issue. Hope fully I will have more information in my hands by then.

Read the RFE

It might not be for a complete medical redo. Sometimes the medical examiners skip certain tests.

For example TB test for pregnant/nursing women is not done. Same thing happened to a freind(ND NOV 01) of mine. She didn't do a TB test at the time of 485 filing bcoz she was pregnant. INS has sent her an RFE to get the TB test done.

Dont lose sleep on this.

Complete medical redo is expensive too but if the company is paying - who cares.

But if the last stage something comes up - it is very annoying and delays the process. I am in the same shoes like Maybesoon - I can understand his pain
