How anyone know how long is the medical exams for I-485 valid for? 6-month or 1 year? I heard both. I did my medical exams last month. Now my lawyer told me she wants to wait until my I-140 is approved before filing I-485. Based on current TSC's I-140 process time, I am still about 9 months away

I also heard and belive medical exam is valid for 1 year but any case immunazation and TB test they are valid for ever, you just have to save the result and present to next medical exam if you need to take one

I was just curious what is benifit of waiting for I-140 approve if it takes 9 months, why not go for concurrent filing ?

The problem was the labor certificate I used was for a person who was laid off. The labor was approved in June, 2002. My I-140 was filed last month. I am a perfect match for the labor certificate. However, because it has been 9 months since the labor certificate was approved, my lawyer was concerned INS might question it, or, though unlikely, deny it. She wants to do safely -- wait until I-140 is approve and then file I-485. This is a company lawyer. What can I say? That's why I have to wait now.

Anyone had this experience before? Does anyone think my I-140 will have problems???

Labor certification (LC) once approved is valid indefinitely. The employer can use it as and when he/she wants it. The only thing that should be taken care of is that the substitute cadidate should have same skills and qualification etc., as mentioned in the approved LC.

I have seen a case where LC was substituted for another person where there was considerable time gap between LC approval and its use for the substitute cadidate. Subsequently the I-140 of this case was approved.

I do not think this will be a reason for your I-140 denial. But with what is going on with BCIS these days we cannot take anything for sure. Wait and see and something negative happens, talk to a good attorney.

Medical exams are normally good for as long as your medical health has stayed the same. If you have participated in any freaky deaky stuff then I would suggest getting a re-medical exam. Otherwise most medical exams are valid.
