I filed my I-485 EB in December 01 without a Medical Clearance form. I had my Medical Exam done in February 02. The logic behind it was that according to a receipt notice it takes 8-12 months to process my case so my Medical would still be valid at an interview time. Now it expired. My lawyer recommends to send it to USCIS upon receiving a RFE from them. He says it would be 50/50 chance that USCIS considers my expired medical. If it does not satisfy USCIS, they will send another RFE requesting a current medical exam. He also says if I send it without RFE then USCIS officials can lose it.
I need a piece of advice from someone who was in my situation or who sent expired medical without RFE from USICS, and it was excepted.
Should I keep it , send it , or just throw it away and get another one done.
