medical exam

As I am EB3 and it is under"U", we could not apply 485. We are asking our attorney to get things prepared so when OCt comes, we might be able to rush into it as our priority date is quite old(11/01). But she asked us to waite until we know the new cut-off date as we need do the med. exam before we turned in 485. I am wondering why we could not do the exam now, just take the risk of second exam. Only downside I can see is pay extra money and take extra personal time off office. Please advise.

There is no reason you could not do the exam now if you like. If you can't file right away like you say you may need to do it again but with your priority date I think I would go ahead and get it done. It takes awhile to get the tests, the results, and the doctors report so why not. It's up to you.
