G. CHINA-MAINLAND BORN AND INDIA EMPLOYMENT-BASED PREFERENCE VISA AVAILABILITY

There has been a significant amount of forward movement in the China-mainland born and India Employment First and Second preference cut-off dates during recent months. This has been done in an effort to generate demand for numbers. It cannot be assumed that these cut-off dates will continue to advance at this pace during the remainder of the fiscal year. It remains to be seen how heavy the demand for visa numbers by applicants from those areas will be in the coming months.
 
See this and predict :

Continued heavy demand for numbers (particularly for adjustment of status cases at USCIS offices) has brought allocations close to the 5,000 annual numerical limit. Therefore, it has been necessary to retrogress the Employment Third preference “Other Worker” cut-off date in an effort to limit future demand. Should the annual limit be reached, it will be necessary to immediately make the category “unavailable” for the remaining months of the fiscal year.

This isabout EB3-- Other worker category they moved back to Oct 2000 most probly next month visa may not available to that category for this year..

where as EB3 regular may move upto April 2001 by Sept
 
EB3 India

EB3 India moved 28 days... 28 days (sorry i had to say it again). I was hoping 1-1/2 months (thats how much it would have taken to make me current)...

Whats up with WW and China ? EB3 didn't move 1 day ? And mexico is moving at below snail pace ?

I feel sad...
 
Disappointing

After the bi-specialization of USCIS, I had hoped for better movements in EB3 dates!
At this snails pace of movement, I don't know how many years it will take the PD to reach mine.
 
Summary of VB for May 2006

EB1-Ihina moved 6 months to July 1, 2004
EB2-China moved 12 months to Jan. 1, 2004
EB3-China doens't move, still at May 1, 2001

EB1-India moved 6 months to July 1, 2005
EB2-China moved 6 months to Jan. 1, 2003
EB3-China moved 1 months to Mar 1, 2001

Bi-specialization hasn't really kicked in so-to-speak. It will take a couple of months for the changes to settle down and results to emerge, whether they are good or bad. Thats my experience with USCIS.
 
After looking few months visa bulletin.........

EB3 India will move APR01 --> June Month
EB3 India will move APR08 --> July Month
EB3 India will move APR15 --> Aug Month
EB3 India will move MAY01 --> Sep Month

So that all the country will meet at MAY01.

God only know what will happen after OCT2006.

Guys,

While it's ok to vent here and express your disappointment, it is important to remember to not be played at the hands of those sh*theads at DOS.

As Saras or someone else mentioned in some other post, I have no doubt either that the bigwigs watch this forum and celebrate after each bulletin published. Celebrate because they enjoy the number of frowns, disgusted looks, anger, disappointment and all the rest that we subject ourselves to when we read these senseless bulletins.

Think about it! Invariably they publish it on a friday thereby ruining many people's weekends (at least the ones who are most emotionally affected). Before soon, this thread will be filled with one too many sighs, hopeless remarks, suggestions of moving back to India, cursing the USA etc. IT'S NOT WORTH IT.

I'd say, let's be men of courage and resilience. Brush off the disgust and disappointment and pretend it doesn't affect us. It's a done deal. Once the numbers are out, they are out, nothing is changing them until the next bulletin.

I hope more posts on this thread will have a different tone than one of lament and regret...just my hope.

And please, please...have we learned yet that prediction is not only wasted effort, it's misguiding and misleading as some simple folks actually get too involved with it...

What do expect

Now comes the age old question of what to expect during the next few months. My personal belief is that EB3 numbers will NOT move until Oct. Hey, if it does, then good for all of us. But, I am trying to be realistic here and adjust my expectation accordingly. I don't want to feel down the second weekend of every month.

Additionally, it appears to me at least, that we cannot expect any relief from the Immigration Reform Bill either. And if you are studying public policy, then DHS/USCIS and this administration's immigration policy is a good example of how one can start losing talent! :mad:
 
EB3s prospects are very bleak this year ...

Guys and Gals,

The May bulletin has proved beyond a doubt that EB3s are not going anywhere this fiscal year (ends Sept 06). My prediction for EB3s is that India will crawl to April or May 01 while the rest of EB3s will not move more than a month or two for the rest of the fiscal year.

Oct 06 may bring some relief to 01 filers but that to is suspect because there is no telling exactly how many 245is are going to be flooding the system then. The best case scenario at this point is that EB3s will move past 01 late this year or early next year. Worst case scenario is that EB3s keep lingering in 01 all the way into early 07 or mid 07.

The above is assuming that no bill is passed in the Congress. This is probably what is going to happen.

Below I have listed a realistic approach based on EB3 PDs - (I have assumed that there will not be any pro immigration bill this year)

Beyond May 2001 PDs - Keep a close eye on the bulletin the next few months and see if there is any movement beyond may. The realistic estimate is that dates for most EB3 categories will not pass May 2001 this fiscal year that ends in Sept 06. There is a glimer of hope beyond Oct 06 but that to depends on a number of factors such as the number of pending 245is.

2002 PDs - Sorry if I sound pessimistic but I think EB3 PDs have very little chance of getting into 02 before early to Mid 07 at best. It might even take longer than that for 2001 to be completed.

2003 PDs and beyond - I think the best thing for now is to keep an eye on things but not get too engrossed in this stuff. I really do not see EB3 dates getting anywhere near 2003 till 2008.

Based on all this I think all of us need to asses our individual situations and make the best decisions under the current circumstances.

Given: Many are applying as EB2 now
Do you think that EB2 World will stay Current or will it retogress too?
 
Rush of EB2s

Guys and Gals,

Just as there was a rush of EB3 filings in 2001-2002 there seems to have been a rush of EB2s in 2003 and beyond. If this is indeed true then it is very likely that EB2s will start stalling in the future. Right now they are moving along nicely but there is already a notice in this months bulletin warning of slower movement in EB1 and EB2 in the near future. We will have to wait and see what happens.

Good assumptions Saras76 and I fully agree with that. PD for EB3 India will not pass May'01 2001 in this fiscal year (2006). But with this scenario the backlog will increase with every passing month. The people who have PD from 2004 onwards and haven't filed their I485, may not be able to do that for many years (taking into account the current scenario). This is too harsh a reality to continue for a long time. So there has to have a change atleast in next FY (07) otherwise will the system will simply collapse. Election year is also round the corner. Some solution is bound to come in near future and the effect will be seen in the start or middle of the FY 07. The immigration billl may fallen today, but it is sent back to SJC for modifications and that will resume on April 24th. If not this bill, there will be something else coming soon. So logically what Saras76 is saying is correct but I am sure this time next year the situation will not be same. Keep it up guys. It's life, so just move on.
