We just received email from FBI about name check:

I am responding to your email dated January 23, 2005, concerning your name check status for immigration purposes.

A review of the FBI's Name Check Program database revealed that a request from the U.S. Citizenship and Immigration Services for you was received on January 10, 2004, and is currently in a pending status. You may be assured that the immigration authorities will be notified at the earliest possible date upon completion of this case.

It's very strange that our 140/485 filed on 10/25/2004, FP done on 11/13/2004, why name check request from USCIS is 1/10/2004? Acturaly we sent two seperate email to FBI, one for my husband and one is mine, the two responses mensioned same date 1/10/2004. May FBI make mistake on date?

USCIS can initiate name check request anytime, it looks like they won't follow any guidelines like name check request should be initiated immediately on receipt of application or after finger print.

I filed my I140/485(EB3) in June 2004(FP in July 2004) and my name check was initiated on Jan 13 2005, which is next day of my I40 approval(Jan 12 2005). My guess on my case was, after approving 140 they took my 485 for process and initiated the name check.
