Matching Resumes for PERM Process

Hi,

Recently my company started PERM process and we have posted ads on news paper, job sites and we received some matching resumes.

What would be the best scenarios to reject these applications? Can we reject applicant that they don't have enough expertise, after conducting a phone screen interview?

Any suggestion is appreciated.

You cannot reject US applicants unless it is for lawful job-related reasons (for example, if you require a degree in computer science, and the person has a degree in music, it is obvious he/she would not be accepted for the position.) The point of a PERM application is not to 'find reasons to reject US workers' but to test the market to see if there are any 'willing, able, or available' US workers to fill the position. Also, if you are the alien for which the PERM application is being filed, you should NOT NOT NOT be involved in the recruitment process whatsoever as it casts doubt on the "Good Faith" recruitment efforts as set forth by the DOL. Your employer should be the ONLY party involved in the recruitment process.
