Masters student/OPT to H1, question.

Hi,

I am a Masters student whose OPT started on March 24th. The thing is I haven't completed my thesis yet but will finish it by July mid- July 21st. I am very concerned about H1's being available and right now am actively seeking out employment. Right now, I don't have any offers. I have two questions.

1. Is there a way to find out how many H1's have been taken from the annual 65000 quota and from the 20000 Masters quota for this year?

2. With the current situation would seeking out a consultant to get a H1 be the best option or can I push things and look out for company sponsored H1's? If I can push, what would be the ideal length of time I can give myself?

Is there anyone else who is facing the same situation as I am now? If so, what is your plan of action?

Please guide me.

Thank you,

Vijay.

---AILA time2time, updates on whats going on with these quotas. Most recently I heard that out of 65K, less than 30K applicant submitted for the H1. Out of 20K for US Masters holders, around 8K has been processed.

---I really don't know if the advise you are seeking would be much more appropriate to be answered or judged by some individual. If you are looking for a company sponsored H1 and later fall on layoff, then your H1 is more or less like screwed. On other hand, consulting job will keep you in bench stating that the project is still underway, or tell INS that you are in vacation.

Ms. IndiraGandhi,

Thank you for your quick reply.

Can you please tell me who/ what AILA is, if it is a website could you please tell me the expansion so I can check it up personally.

I am an electrical engineering graduate, I am hoping that hiring will be good and layoffs low. Do you think it is practical on my part to wait for a company based job for a while?

Besides, does the additional 20000 quota for the FY2006 open up in October too? Could you/ anyone confirm that here please.

Thank you.

Vijay.

Ms. IndiraGandhi,

I have found AILA from googling. Thank you for the information. Looked it up in detail but couldn't find where they update the H1 information. Could you please guide me to that?

Thank you,

Vijay.

---AILA stands for American Immigration Lawyer Association.
WebSite is http://www.aila.org
You can also refer to your query to either www.murthy.com or www.immigration-law.com (these are lawyers website, where they constanlty updates the DOL and USCIS announcements)

---Its entirely your choice, I should not comment on that part. I am sorry.

To be honest with you, I have not searched any literature on this, but its been confirmed by believers that the quota for FY 2006 will be an open end to US masters student in the same ratio as in FY 2005.

Thank you again for your replies and information. I will follow up on what I've gotten to know here.

when to apply for h-1?

Hi,
The 20,000 H-1 quota which was allocated for this year (FY2005,for the Masters Students) will the same be allocated next year (2006)?
I have a Masters Degree and Iam currently on OPT.My EAD card expires in May 2006.
Is it a good idea to apply for H-1 visa in April 2006 so that I can have immediate start date in May 2006?

I followed the information I had here and it seems the 2006 quota for Masters students also exists alongwith the 20000 in 2005. You can apply any time and get it if there're enough visas to go around. The consensus is the visas will last at least until December(realistic estimate) or February 2006(optimistic estimate).

Thanks for your quick reply.
Last week I had an interview and I got selected in it.A third party consultant will be filing my H-1.My EAD card is valid for about 10 months from now and I would like to avail the tax benefits on my OPT.
Is there any way , where I can have the start date of working with my H-1 close to the expiry date of my EAD card (EAD expires on may 15th 2006).

No idea about that. I'm still looking for a job. So, did you get a job from a consultant? Could you tell me which field? I suggest you make a separate post about your case, I think someone here might know and could help you out.
