So I have a master hearing coming up next week in Santa Ana court and I will be going with my family since I’m under their case. We are really scared about the ICE. What are the chances of us being detained at the Santa Ana Courthouse? We had filed for a political asylum in 2016 and we got our first interview in 2025 in Tustin asylum office and unfortunately we got referred to the court. Any suggestions please? We do have a lawyer and he will be joining us thru zoom and me and my family are going in person.

Being referred to court means your family is in deportation proceedings.

Typically, you guys will be safe if the outcome of the case is asylum grant or any other form of relief. If you guys are denied asylum, I think the ICE/cbp officers might pick you up for deportation.

If I was in your position, I would go to the hearing, with the expectation that I might be detained. Why?

I have seen multiple reports of people, spouses of US Citizens, being detained when they went to their green card interviews. If they can do this to spouses who are not in deportation proceedings, then definitely they can do that to you guys.

Once, someone I know fell seriously ill. Initially, their lawyer requested to attend the hearing via Zoom since the judge works from home. However, during that given date, the judge had some issues with his computer and was coming to court. The court staff informed them that judge wanted them to attend in person. Since they couldn’t attend, the lawyer requested a different hearing date, which they received after a few months. Hope it helps you.

How did all this went? I have my court coming up in couple of days as well
