Marrying an Australian Citizen

Hi all,

I have my GC and I am marrying somebody who has australian citizenship. She currently resides in Australia. Does anybody knows what's the best possible way to bring her here. What's the normal time for an Australian Citizen to get her GC, if I file her GC after marriage.

I would really appreciate all your candid responses.
Thanks in advance,
Kapil

Your spouse will come under F2A preference category which is backlogged to August 2000. Expect it to take at least 4 years to get your wife a green card based on her marriage to you.
Once you obtain US citizenship she will not be subject to any quotas. In that case the processing time will be around 1 year.

When to use a lawyer for spouse processing?

Are there any hard and fast rules as to when it's necessary to use a lawyer for spouse of a US citizen?

As a green card holder sponsoring wife takes 5 years or so. You would be better off encouraging her to come here in non-immigrant status like F1 or H1 prior to marrying her. Because once she marries you she can't prove that she is not an immigrant (for F1). H1 can have dual intent. But H1 visa's have almost run out for the current year. As an Aussie she does not need a visitor's visa. She could travel here freely for 90 days at a time till you work out a job or somthing for her but sponsoring her when you have a citizenship is the easiest, that is if you are near to that stage.
