Marrying after 8 years, please need advise!

I started dating my fiance about 8 1/2 years ago, back then i had a green card. I live in San Diego, so im right at the border.

My fiance have been using a tourist visa por almost 13 years, in fact she just got it renewed last year or so.

Anyways were planning to get married, but i have been reading there might be an issue marrying with a Tourist visa. Does she have to apply forthe K-1 visa? or the tourist visa, giving the circumstances will do? she didnt get the visa just last month, shes been coming in and out of the US for a while.

Please advise. thanks
 
She already has a B visa tho. Do i have apply for another visa? can she still keep her B visa( 10 years ).

ANother thing, shes pregnant will that matter?
 
See it will be better if she takes the K1 route... she can go back and then you guys apply the K1. Though there are cases where people came to US on B2 visa, got married to a USC and then adjusted the status, but that path is full of uncertainities as it may lead the INS to believe that she (your wife) came to US with the intent to immigrate - which is against the law.

I have a friend - on this forum itself - Patty759 (you can read about her case here -> http://www.immigrationportal.com/showthread.php?t=215729&page=6&pp=15). Her BF is a USC who she had met in Germany and had spent some time with him there. Last year she came to US on B2 to spend some time in US and intended to apply for K1 later, but when she went to USCIS thru infopass to ask about K1, the lady there told her to use do AOS and said that it would be okay. So Patty stayed and filed for AOS, now she is very worried because people told her that her AOS would be denied when INS comes to know that she knew her BF before coming to US.

Im praying that she gets her AOS approved without problem, but, wouldn't want another soul to go through the same agony. I would suggest K1 - but its your call in the end. Good Luck.
