Marrying a greencard Holder

Hi,

I am an Indian citizen employed in USA on H1 Visa.

I am getting married next month and she is a Permenant Resident of USA. She is finishing her 5 years of stay in USA in March, 2007 and she will apply for citizenship after that.

Which is the best step i can take?

Can i apply for EAD now or i should wait till she becomes citizen of USA.

Hello,

It is upto you what step you want to take. What time your H-1B is expiring? It is advisable that she becomes a US citizen and then you get married to her and file for the AOS.

You can not file for the AOS if she is not a US citizen (Family based Green Card).
